Indiana Class Action Lawsuit Attorneys
We fight for you.
Class action lawsuits allow groups of people who have been similarly damaged to pursue claims that may not be big enough to pursue in separate, individual lawsuits. Class action lawsuit attorneys at Cohen & Malad, LLP handle class action lawsuits involving class members not only in Indianapolis and throughout the state of Indiana but also in class actions that are multi-state, nationwide, and international in scope.
Class action lawsuits bring a wide variety of claims. Some examples include:
- consumer claims against banks for improper fees
- claims against insurance companies for denials of benefits
- claims on behalf of workers for under-compensation
- claims for privacy violations for data security breaches
- claims for defective products
For example, some banks charge their customers excessive account overdraft fees that add up to millions of dollars for the banks but which are in relatively small amounts for each customer. It might not be practical for a customer to bring a lawsuit to recover a few dollars in overdraft fees for one bank account but that customer could pursue the same claim in a class action lawsuit on behalf of all customers whose accounts were overcharged thus requiring the bank to disgorge millions in unearned fees.

Millions Recovered for Victims in Consumer Protection Class Actions
Class action lawyers at Cohen & Malad, LLP obtained recoveries of millions of dollars against the Indiana Bureau of Motor Vehicles for overcharging drivers for drivers licenses and other fees, and against the Indiana Department of Child Services for failing to pay adoption subsidies owed to families who adopted children out of the state’s foster care program. In addition to those claims against the state government on behalf of Hoosiers, Cohen & Malad, LLP recently obtained recoveries on behalf of truck drivers from across the country who had been overcharged for fuel purchases by a trucking company, and on behalf of insureds in a dozen states who had been deprived of payments owed to them by an insurance company under their automobile insurance policies. The class members in these cases received payments ranging from a few hundred dollars to thousands of dollars, without having to hire a lawyer on their own and without having to file their own lawsuits.
Class Actions for Victims of Price-Fixing and other Antitrust Violations
Antitrust violations occur when manufacturers use their size and market strength to illegally prevent fair competition in an open market, and when sellers conspire to fix prices, secretly divide customers among themselves, or cheat on bidding for public projects. These antitrust schemes cost other, usually smaller, businesses and individuals millions of dollars in inflated costs. Cohen & Malad, LLP’s team of class action lawsuit attorneys act to restore competition and recover illegally inflated fees for victims of antitrust violations. For example, Cohen & Malad, LLP brought a class action lawsuit against central Indiana manufacturers of ready mixed concrete for price-fixing, which resulted in a $59 million recovery, as well as a similar class action in Iowa that was resolved for over $18 million. Like the cases involving consumer claims, even though the total amounts recovered were substantial and resulted in significant payments to individual purchasers of ready mixed concrete, those customers were not required to pursue their claims in hundreds or thousands of separate, individual lawsuits.
Class Actions to Protect Human Rights
On an international level, Cohen & Malad, LLP played a role in historic human rights class action litigation against Swiss banks and German companies based on their involvement in the crimes of the Nazi era, which resulted in total recoveries of $6.25 billion for Holocaust survivors throughout the world. Cohen & Malad, LLP continues to investigate and pursue class action claims on behalf of victims of human rights violations, including victims of human trafficking.
A Reputation for Success in Complex Cases
Class action litigation is complex. It takes a high level of skill for a firm to litigate claims on behalf of a class. United States District Judge Mark W. Bennett, who presided over In re Iowa Ready-Mix Concrete Antitrust Litigation, had the following to say about Cohen & Malad, LLP’s representation of the class:
“In more than thirty-six years of lawyering and judging, I have never been prouder to be a lawyer/judge than when I observed the lawyers, in this case, plying their chosen craft. This case has been to me what it was like when I stood before daVinci’s Mona Lisa and Michelangelo’s David, observing the great masters’ works. I was overcome with the rare and gargantuan sense of awe that will likely last a lifetime.”
