South Madison Community Schools Failed to Prevent, Protect Students from Sexual Assault
A lawsuit filed in Madison County, Indiana asserts that South Madison Community Schools and its officials failed to respond adequately to reports of sexual assault, neglected to protect students from potential harm, and failed to provide staff sufficient training for such incidents.
In January 2023, a female student participating in the Best Buddies program at South Madison Community Schools reported being assaulted by a male student. The incident was related to other students and teachers, however neither the girl’s parents nor school administrators were promptly informed of the assault.
Additionally, the assailant purportedly had a history of sexually inappropriate behavior at school prior to the incident.
The lawsuit filed in Madison County alleges that school officials 1) neglected to take reasonable measures to minimize contact between the girl and the offender, 2) failed to promptly investigate reports of sexual harassment and assault, 3) neglected to conduct timely investigations, 4) failed to ensure the safety of its students adequately, and 5) failed to adequately train school staff regarding proper monitoring of students, the prevention of assaults, and the process of reporting allegations of sexual assault when they occur.
