BP Ordered to Pay $7 Million in Contaminated Gas Lawsuit
INDIANAPOLIS, IN [November 26, 2013] — The Honorable Robert Gettleman granted final approval of a $7 million class action settlement against BP Products North America, Inc. (BP) over contaminated gasoline recalled in August 2012. This settlement includes damages, costs and fees for the class comprised of motorists who purchased tainted gasoline that was distributed to more than 575 retail outlets in Indiana, Illinois, Wisconsin, and Ohio. Class counsel included attorneys from Cohen & Malad, LLP and Price Waicukauski & Riley, LLC of Indianapolis.
“We are glad that BP stood up and did the right thing by compensating Indiana residents for gas they purchased from the Whiting Plant that did not measure up to the quality that BP is known for. This result demonstrates that the legal system is designed to help the citizens of this state and I’m proud to have worked with the lawyers in this case to achieve this good result,” stated Will Riley of Price Waicukauski & Riley, LLC.
The tainted gasoline was found to have higher-than-normal levels of polymeric residue which caused damage to engines and fuel systems.
“We are pleased that after several months of litigation BP has agreed to settle these claims through the court system giving justice to consumers who purchased this tainted gasoline,” said Irwin Levin of Cohen & Malad, LLP.
